Terms and Conditions for Above & Beyond's We Are Anjunafamily Fan Story Campaign Submissions

1. Introduction and Acceptance
By submitting any content (including written stories, photographs, videos, or other materials) through the online fan submission form ("Submission"), you ("User" or "you") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Involved Productions Ltd., a company registered with Companies House in England and Wales under number 053 966 00 whose principal place of business is at 65 Decima Street, London SE1 4QR ("Involved Productions", "Company", "we", "us", "our").
Important: Please read these Terms carefully before submitting any content. If you do not agree to these Terms, do not submit any content.
2. Eligibility and Age Requirements
- Users must be at least 18 years of age to participate with a valid email address.
- Users must acknowledge and understand how your content will be used.
- Void where prohibited by law.
3. Content Licensing and Usage Rights
3.1 License Grant
By submitting content, you grant Company and its successors, assigns, licensees, and sublicensees an irrevocable, perpetual, non-exclusive, royalty-free, fully-paid, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise exploit your Submitted Content (in whole or in part) in any and all media now known or hereafter devised, including but not limited to:
- Music videos and audiovisual productions
- Promotional and marketing materials across all platforms
- Social media content and digital campaigns
- Website display and microsite integration
- Live performances and broadcast events
- Artistic projects related to Above & Beyond and their albums
- Educational and documentary purposes
- Any other use in connection with Company's business operations
3.2 Attribution and Credit
- Company may, but is not required to, provide attribution to you in connection with any use of your content
- You may specify your preferred attribution format (legal name, stage name, or anonymous) at submission
- If you request anonymity, Company will respect such request unless disclosure is required by law
- Company reserves the right to modify, abbreviate, or omit attribution based on space limitations, platform requirements, or creative considerations
- You are the sole owner and creator of the Submitted Content or have obtained all necessary rights, licenses, and permissions
- Your content is original and does not infringe upon any third-party intellectual property rights, including copyrights, trademarks, moral rights, publicity rights, or privacy rights
- No additional permissions are required from any persons depicted, referenced, or whose voice, likeness, or performance appears in your content
- Your content does not violate any applicable laws, regulations, or third-party agreements
- You have the full right, power, and authority to enter into this agreement and grant the rights herein
- Your content does not contain any confidential, proprietary, or trade secret information belonging to third parties
- Your content does not contain defamatory, obscene, threatening, or otherwise objectionable material

5. Moral Rights and Intellectual Property
Moral Rights Waiver (Where Legally Permissible): To the fullest extent permitted by applicable law, you waive and agree not to assert any moral rights or similar rights you may have in your content, including rights of attribution and integrity. Where moral rights cannot be waived, you agree not to exercise such rights in a manner that would interfere with Company's exploitation of your content.
Intellectual Property Protection: While you retain ownership of your original content, the licenses granted herein are perpetual and irrevocable. You acknowledge that Company may develop or have developed materials similar to your content independently
6. Privacy and Data Protection
6.1 Data Collection and Processing
We collect and process your personal information in accordance with our Privacy Policy and applicable data protection laws, including:
- GDPR (UK/EU users): Processing based on your consent, which you may withdraw at any time
- CCPA (California users): You have rights to know, delete, and opt-out of sale/sharing of personal information
- Australian Privacy Principles: We collect only information reasonably necessary for our functions
6.2 International Data Transfers
Your information may be transferred to and processed in countries outside your residence, including the UK, US, and other territories. We implement appropriate safeguards including:
- Standard Contractual Clauses for GDPR compliance

Content Standards and Prohibited Content
7.1 Acceptable Content
Your submissions must be appropriate for a general audience and consistent with Above & Beyond's brand values. Content should be positive, creative, and celebrate music and community.
7.2 Prohibited Content
You may not submit content that:
- Infringes third-party intellectual property rights
- Contains hate speech, discrimination, or harassment
- Includes violence, illegal activities, or dangerous behavior
- Contains sexually explicit or inappropriate material
- Violates privacy rights of individuals depicted
- Includes copyrighted music without proper clearance
- Contains defamatory or false information
- Promotes harmful or dangerous activities
- Violates local laws or regulations in any applicable jurisdiction
8. Content Moderation and Removal
Company reserves the absolute right, but not the obligation, to:
- Monitor, review, modify, or remove any submitted content at any time
- Remove content that violates these Terms or applicable laws
- Modify content for technical, legal, or editorial reasons
- Implement automated content filtering system
Under these terms, the Company is not obligated to provide notice to you for taking such actions, however you may reach out to our contact inbox should you have any specific questions.
9. Indemnification
9.1 User Indemnification
You agree to defend, indemnify, and hold harmless Company, its affiliates, officers, directors, employees, agents, and licensees from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Any breach of your representations, warranties, or covenants
- Any claim that your content infringes third-party intellectual property rights
- Any claim arising from your violation of any law, regulation, or third-party rights
- Any claim by persons appearing in or contributing to your content
9.2 Procedures
The indemnified party must promptly notify you of any claim and allow you to control the defense and settlement, provided you do not settle without the indemnified party's consent if the settlement affects their rights or requires their performance.
10. Limitation of Liability
By participating and making a Submission, you agree to release and hold harmless the Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation.
Company disclaims liability for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.
No warranty is provided regarding the use, display, or promotion of your content, and Company makes no guarantees about featuring or highlighting your submissions. This limitation applies regardless of the legal theory and even if Company has been advised of the possibility of such damages. Some jurisdictions do not allow certain liability limitations, so these may not apply to you.
11. Requests for Removal of Your Content
Removal Requests
Should you want your submission removed from relevant platforms, including but not limited to the website and microsite or social channels, please reach out to us via our contact form.
We will try our best to get back to you within 10 business days, and we will do our best to honor your request to remove your content. Please note that in some cases on some platforms, it is not possible to remove content. These cases will be explained in more detail in your request for removal.
Only the user who submitted the content can request the removal. Removal requests must be submitted with the same email as the original submission, or the user must prove their authenticity in another way.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. Consumer Protection: Nothing in this clause deprives consumers of their rights under applicable consumer protection laws in their jurisdiction of residence.
13. International Compliance
13.1 Multi-Jurisdictional Compliance
These Terms are designed to comply with the laws of multiple jurisdictions. Where local laws provide greater protections, those laws will apply.
13.2 Severability
If any provision of these Terms is found to be unenforceable in any jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, will be severed, without affecting the validity of the remaining provisions.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding your submissions.
14.2 Modifications
Company may update these Terms periodically. Material changes will be communicated through email or prominent notice on our platforms. Continued submission of content after changes constitutes acceptance of modified Terms.
14.3 Assignment
Company may assign these Terms without your consent. You may not assign your rights or obligations without Company's written consent.
14.4 No Waiver
Company's failure to enforce any provision does not constitute a waiver of that provision or any other provision.
